Terms and conditions regarding the use of the site and the privacy policy according to Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

MPIRE PROPERTIES & DEVELOPMENT S.R.L. assumes no responsibility for damages caused by the use/non-use of any information obtained from the Site. All information present on the website of an informative nature. Likewise, MPIRE PROPERTIES & DEVELOPMENT S.R.L. is in no way held responsible for losses (direct or indirect), loss of business opportunities or opportunities or for unrealized benefits, by the user, as a result of the non-functioning or improper functioning of the Site.

5. Force majeure

Neither party shall be liable to you for failure to perform its contractual obligations if such failure is due to a force majeure event. Force majeure is the unforeseeable event beyond the control of the parties and which cannot be avoided.

6. Applicable law – jurisdiction

By accessing the website, Users agree that any dispute/dispute/lawsuit will be resolved in accordance with Romanian legislation. It also agrees to jurisdiction to be established before the Romanian courts of the seat of the Site Owner.

7. Disputes and Final Dispositions

Any other problem caused by the products presented on mpire.ro or by the information presented on this site and which is not already dealt with by any article in this document, shall be resolved amicably within 30 working days from the date of notification in writing of the problems, by the user. In the event that the amicable settlement of the conflict has not been achieved, the competence rests with the Romanian courts, the parties choosing the competence of the courts within the radius of the municipality of Bucharest.

8. Information on the protection of personal data

MPIRE PROPERTIES & DEVELOPMENT S.R.L. (mpire.ro) processes your personal data, by automated means, the purpose being the record of the delegated and/or authorized persons of MPIRE PROPERTIES & DEVELOPMENT member companies, invoicing and payment registration for the products and services provided by MPIRE PROPERTIES & DEVELOPMENT S.R.L. according to your subscription and further informing you from a distance about the service provided, when appropriate.

In connection with the processing of personal data based on the conditions specified in the European Data Protection Regulation, you can exercise any of the following rights, as listed in art. 13 of Regulation 679/2016, respectively:

• The right of access to personal data – the data subject can request the right of access to personal data, under certain conditions.

• The right to rectification – personal data can be rectified at any time, or modified as appropriate

• The right to delete data – data processed to be deleted, in the situation where their processing was not legal

• The right to restriction of processing – the data subject has the right to obtain from the operator, without undue delay, the rectification of inaccurate personal data concerning him

• The right to file a complaint with us and/or the competent data protection authority

• The right to withdraw consent – the withdrawal of consent only affects you for the future, the processing carried out prior to the withdrawal still remaining valid;

• The right to go to court

• The right to object – the data subject can object to data processing based on our legitimate interest;

• The right to lodge a complaint – the person whose data has been processed, lodges a complaint against the manner of personal data processing to the National Authority for the Supervision of Personal Data Processing

Also, your right to appeal to justice is recognized.

9. Data storage period

The user’s personal data will be processed for the duration of the contract, and will be stored for another three years, after its completion. For documents that require a longer retention period, according to the legal provisions in force, the storage period will be similar to that provided by the special law.
